Setback for USA transgender campaigners as judge blocks Obama policy

At the direction of Gov. Bevin, Kentucky joined in the 13-state coalition in the federal court lawsuit in the Northern District of Texas challenging the Obama administration's overreaching federal directive on public school bathroom policies. Judge O'Connor also took issue with the directive's statement that gender identity should be treated as a student's sex when looking to apply Title IX. The administration interprets Title IX to include discrimination based on gender identity.

A US judge blocked an Obama administration policy that public schools should allow transgender students to use the bathrooms of their choice, granting a nationwide injunction sought by 13 dissenting states just in time for the new school year.

The Department of Justice expressed disappointment over the ruling and said it is reviewing its options. Additionally, the letter mandated that school districts integrate transgender students into their preferred locker rooms, athletic teams and other facilities. One important backer of transgender rights in Tennessee, the state chapter of the American Civil Liberties Union, responded to the decision by saying transgender students have a right to go to school without facing discrimination.

In his ruling, O'Connor said there was a strong likelihood that the dissenting states will win their lawsuit.

The Obama administration had told the court that recipients of federal education dollars were "clearly on notice" that anti-discrimination polices must be followed. "The decision is certainly emotional, and certainly an attack on transgender students' dignity".

"The court's misguided decision targets a small, vulnerable group of young people - transgender elementary and high school students - for potential continued harassment, stigma and abuse", the groups, including the ACLU, said in a joint statement.

On Sunday night, a federal judge ruled to not enforce the Obama administration's attempts to protect and extend civil rights to transgender students.

The U.S. Supreme Court ruled in June 2015 that the Constitution guarantees a right to same-sex marriage.

Texas was the lead-plaintiff in the case. Earlier this month, the U.S. Supreme Court ruled that a Virginia school board can block, for now, a transgender male from using the boys restroom while justices decide whether to fully intervene. So let us make it clear to those districts: "your obligations under the law have not changed, and you are still not only allowed but required to treat transgender students fairly".

The new health regulations broadly affect the health care system because service providers who accept federal funding have to comply.
